FMCSA's Call for Truck Lease Agreements is Combating Predatory Practices for Driver Safety


The Federal Motor Carrier Safety Administration is requesting lease agreements from truck drivers, especially if they suspect predatory or fraudulent terms. This is part of the Truck Leasing Task Force's (TLTF) efforts to address deceptive leasing practices affecting drivers' safety and well-being. TLTF, established by Congress and led by FMCSA, aims to assess the fairness of leasing arrangements between owner-operators and trucking companies. They seek to identify and rectify exploitative practices, such as burdensome debt and unfair repayment terms.

During TLTF meetings, they discuss inquiries for drivers with potentially harmful leases and those with positive experiences, aiming to understand the context of fraudulent agreements. TLTF member Steve Viscelli emphasized the importance of collecting data to make recommendations for policymakers on improving safety and addressing predatory leasing practices.

The FMCSA will share responses with the Consumer Financial Protection Bureau, emphasizing the need to redact personal information before submission. Comments on this initiative will inform TLTF's next public meeting, planned for March in Kentucky.

In addition, FMCSA updated its detention time study, focusing on the relationship between detention time and driver compensation. Although the study won't initially address the impact on driver welfare, this topic may be explored in future studies.
